By accessing or otherwise interacting with our services, servers, social media pages, website ("Site"), mobile apps ("Apps"), or any associated content, you agree to these Terms and Conditions. Gopher is a private site owned and operated by Gopher, Inc. If you do not agree to these Terms, you are not authorized to use Gopher or download the Apps.
1Agreement Between User and Gopher, Inc.
We may modify our Terms and Conditions at any time, at our sole discretion. We will notify you by email whenever these Terms change. If you have unsubscribed from our email communications, you are responsible for periodically checking for changes and are bound by them if you continue to use Gopher.
Our Privacy Policy, Prohibited List, and all other policies, site rules, and agreements referenced below are fully incorporated into these Terms, and you agree to them as well. We require you to agree to the current version of our Terms, as well as our SMS disclaimer, each time you sign in to the Apps. For your convenience, you will be notified via your Gopher inbox when there is a change.
www.gophergo.io is the website associated with the mobile and web apps. Gopher Request, Gopher Go, and Gopher Connect are the names of the three platforms used. Gopher is a dual-platform on-demand community marketplace app that facilitates the delivery of any good and/or service — the perfect companion for anyone who needs help with an errand, chore, or task.
2Privacy
Your use of Gopher, Inc. is subject to Gopher's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.
3Electronic Communications
Visiting Gopher, Inc. or sending emails to Gopher constitutes electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically — via email, on the Apps, and on the Site — satisfy any legal requirement that such communications be in writing.
You further agree that clicking or tapping “Confirm,” “Accept,” “Complete,” “Submit,” “I Agree,” or similar buttons, and otherwise affirmatively indicating your assent within the Apps or Site, constitutes your electronic signature and your intent to be bound, and has the same legal effect as a handwritten signature.
4Your Gopher Account
If you use this Site and/or Apps, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer and/or the Gopher Request and Gopher Go Apps. You agree to accept responsibility for all activities that occur under your account after signing in. You may not assign or otherwise transfer your account to any other person or entity.
You acknowledge that Gopher is not responsible for third-party access to your account that results from theft or misappropriation. Gopher and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion. If you receive a new SMS number, you must contact support@gophergo.io to request the number change rather than creating a new account.
5Account Registration
You may register only one Gopher account via SMS. This account gives you access to both Gopher Request and Gopher Go. At sign-up, we ask for your mobile number; once submitted, you receive a 6-digit one-time passcode (OTP).
The information you provide for your Gopher Profile must be accurate and complete, and you must keep it current — including your legal name, your actual date of birth, your permanent address, and a recent profile picture. Inaccurate information may result in removal from Gopher. You are responsible for use of your account, so please do not let anyone else use it, and keep your OTP confidential. If you identify suspicious activity, please notify support@gophergo.io immediately.
6Marketplace Facilitator & Independent Contractor Relationship
Gopher, Inc. operates a digital marketplace that facilitates the connection between individuals and businesses seeking services ("Requestors") and independent service providers ("Gophers"). Gopher, Inc. acts strictly as a neutral technology platform — a "connector" or venue — that introduces Requestors and Gophers to one another. Gopher, Inc. does not provide, perform, supervise, direct, or participate in the services advertised on the platform, and does not employ, engage, or retain Gophers.
All Gophers are independent third-party contractors who offer services directly to Requestors. Gopher does not supervise, direct, or control the manner or means by which services are performed.
Direct Offer Model
Through the Gopher Request application, Requestors make direct offers to independent Gophers for specific services. Gophers may accept, reject, or counter these offers at their sole discretion. Upon acceptance, a direct agreement is formed between the Requestor and the Gopher. Gopher is not a party to this agreement and is not responsible for the performance of the services.
Safe & Lawful Performance
Gophers are solely responsible for determining whether a requested service can be performed safely and lawfully. A Gopher may decline any request they believe presents an unreasonable risk of injury, property damage, or legal liability. Acceptance of a request constitutes the Gopher's representation that they are willing and able to perform the requested service safely, lawfully, and competently.
Platform Fee & Payment Facilitation
Gopher charges a small platform facilitation fee to Requestors for use of the marketplace and payment processing services. This fee enables Gopher to facilitate secure payment processing and ensure that funds are released to the Gopher promptly after the Requestor confirms completion of the service. Gopher does not set worker compensation or control pricing.
No Guarantee of Matches, Fulfillment, or Earnings
Gopher, Inc. does not guarantee that any request will receive responses, bids, acceptance, completion, or successful fulfillment. Because Requestors set their own price and any offer must be voluntarily accepted by an independent Gopher, a match may not occur, and Gopher, Inc. does not promise that one will.
Likewise, Gopher, Inc. does not guarantee to any Gopher any minimum amount of work, earnings, opportunities, requests, acceptance rate, or future availability of requests through Gopher Request, Gopher Go, or any other platform offering. Earnings depend on factors outside Gopher's control, including Requestor demand and a Gopher's own activity.
7Gopher Connect
Gopher Connect is an extension of the Gopher platform. Like Gopher Request, it allows users to use the platform to find and arrange help from independent service providers — in this respect the two platforms operate identically. Except where expressly stated otherwise, Gopher Connect is fully governed by these Terms, including the marketplace-facilitator and independent-contractor relationship described in Section 6, the fee provisions in Sections 10 and 11, and the assumption-of-risk and liability provisions in Section 31. Gopher, Inc.'s role on Gopher Connect is the same as on Gopher Request: it acts strictly as a connector and is not a party to any agreement formed between a Requestor and a Gopher.
Plans & Fees
Gopher Connect is offered through tiered plans, and all fees are disclosed transparently at checkout before a request is confirmed. The figures below are provided for reference and may be updated from time to time; to review current pricing, always check the Gopher Connect website.
Connect Starter has no monthly subscription and includes 5 free requests per month. If those 5 free requests are used up, an additional block of 5 requests may be purchased for $35. Purchased requests do not expire — any that go unused carry over when the monthly free allotment resets.
Connect Business includes a recurring subscription of $49.99 per month, with per-use fees charged on the same basis as Gopher Request. The subscription is billed monthly on a recurring basis until cancelled.
Connect Enterprise is a custom plan priced according to each company's requirements. To obtain Enterprise pricing, contact connect@gophergo.io.
Except as described above, Gopher Connect fees are governed by the same provisions as Gopher Request (Sections 10 and 11).
Connect Business Subscription — Billing, Cancellation & Refunds
The Connect Business plan is a recurring subscription. By subscribing, you authorize Gopher, Inc. (through our payment processor) to automatically charge your payment method $49.99 each month, plus any per-use request fees incurred that month, on a recurring basis until you cancel. You may cancel at any time from your account settings or by contacting connect@gophergo.io; cancellation takes effect at the end of the then-current billing period and stops future renewals.
Subscription fees are non-refundable. Cancelling ends future charges but does not refund or pro-rate the current billing period, and no partial-month, unused-time, or inactivity credits are issued. Your Connect Business access continues through the end of the period you have already paid for and then ends. This applies regardless of how much you used the plan during that period. Per-use request fees are handled under the Cancellation & Refund Policy for individual requests.
Gopher, Inc. may change the subscription price or plan features on a going-forward basis; we will provide notice before a change takes effect, and your continued subscription afterward constitutes acceptance of the new price. If a subscription charge fails, Gopher may retry the charge and may suspend or downgrade Connect Business access until payment is resolved.
Gopher Connect may also provide business customers with tools such as consolidated worker-payment summaries and downloadable reports. These tools are provided for convenience and record-keeping, are informational only, and are governed by our Taxes section — Gopher does not issue tax forms or determine any user's tax obligations.
8Gopher Deals
Gopher Deals is a semi-informal merchant partnership program created to reduce the strain and cost of third-party integrated delivery and assistance. It allows participating merchants and businesses to showcase their offers to the entire Gopher Marketplace community — including Requestors and Gophers — at no transactional cost to either side.
How Deals Work
When a user browses Gopher Deals and finds an offer of interest, Gopher provides a link directing them to the merchant's own online ordering portal. Any purchase is made directly through the merchant on the merchant's own website or platform. Gopher, Inc. does not collect, process, or receive any portion of a Deal purchase. Gopher does not set, control, or interfere with the substance of a merchant's offer; we simply encourage merchants to make their Deals trackable on their end.
Gopher's Role Is Listing Only
For Gopher Deals, Gopher, Inc. acts solely as a listing and discovery service. Gopher is not a marketplace facilitator, seller, agent, or party to any transaction between a user and a merchant, and no payment for a Deal passes through Gopher. The marketplace-facilitator and payment-facilitation provisions described in our Marketplace Facilitator & Independent Contractor Relationship section do not apply to Deal purchases. Because Deals direct you to outside merchant sites, the provisions on Links to Third-Party Sites & Services also apply.
Deal Submission & Approval
Merchants may submit a Deal for listing through Gopher. Merchant participation is separately governed by the Gopher Deals Merchant Agreement, which a merchant accepts when submitting a Deal. Gopher aims to review and approve or deny submitted Deals within five (5) business days. Each submission is reviewed against these Terms and the Gopher Prohibited List, and Gopher may decline or remove any Deal at its sole discretion. Once a Deal is approved, the merchant's approved offerings may be listed on the platform. Approval reflects only that the listing is permitted; it is not an endorsement, guarantee, or verification of the merchant, its products, its pricing, or its fulfillment.
Redemption, Refunds & Merchant Responsibility
When you redeem or purchase a Deal, you are transacting directly with the merchant, and the merchant's own purchasing terms, pricing, availability, and policies apply. The merchant is solely responsible for honoring the Deal, fulfilling the order, and handling any returns, refunds, cancellations, warranties, or disputes. If a Deal is misrepresented, not honored, or otherwise unsatisfactory, responsibility rests with the merchant. Gopher, Inc. makes no representations or warranties regarding any merchant, Deal, or product and assumes no liability for them.
Turning a Deal into a Gopher Request
Any Deal can be converted into an instant Gopher Request when a user wants help related to a Deal purchase — for example delivery, assembly, or installation. This “last-mile” assistance is a separate, independent transaction governed by these Terms like any other Gopher Request: the relationship is 100% between the user and the independent Gopher, with Gopher, Inc. acting only as the connector described in our Marketplace Facilitator & Independent Contractor Relationship section. The merchant is not a party to, and bears no responsibility for, any Gopher Request arising from a Deal.
Your Responsibility on Merchant Sites
Because a Deal directs you to a merchant's own website, ordering portal, or platform, you are solely responsible for every charge, payment, subscription, account, and credential you enter or authorize on that merchant site, and for reviewing the merchant's own terms of sale, cancellation terms, and privacy policy before you transact. The account you are signed in under is responsible for all activity and financial transactions conducted through it on a merchant site. Gopher, Inc. never sees, collects, processes, stores, or has access to the payment information you provide to a merchant, and does not receive any portion of what you pay. Any financial transaction on a merchant site is entirely between you and that merchant.
No Guarantee of Availability, Pricing, or Endorsement
Deals may expire, sell out, change, be corrected, or be withdrawn at any time without notice. A listed Deal is a merchant promotion surfaced for discovery — it is not an offer that Gopher, Inc. is able or obligated to honor, and Gopher does not guarantee any Deal's availability, price, accuracy, inventory, or that a merchant will continue to offer it. Listing or approval of a Deal is never an endorsement, recommendation, verification, or warranty of the merchant, its products, its pricing, its legitimacy, or its fulfillment. You are responsible for confirming the current price and terms on the merchant's site before purchasing.
Regulated & Age-Restricted Deals
Where a Deal involves alcohol, tobacco, or other age-restricted, licensed, or otherwise regulated goods or services, the merchant is solely responsible for all legal compliance associated with the sale — including age verification, licensing, permitted sale and delivery, labeling, and any applicable local, state, and federal law. Gopher, Inc. is not the seller and assumes no responsibility for a merchant's compliance. If such a purchase is turned into a Gopher Request for delivery, the age-restricted delivery rules in our Age of Usage & Age-Restricted Deliveries section apply to that Gopher Request in full.
Merchant Fulfillment & Deals Privileges
Participation in Gopher Deals is a revocable privilege, not a right. Approval and continued listing confer no guarantee of placement, duration, transaction volume, or exposure. Gopher, Inc. may suspend, restrict, decline, or revoke a merchant's Deals privileges at any time, in its sole discretion, including where a merchant repeatedly or materially fails to honor or fulfill a listed Deal, misrepresents an offer, violates these Terms or the Prohibited List, or generates a pattern of user complaints or disputes.
If a merchant fails to fulfill its end of a Deal and the user has separately initiated a Gopher Request in connection with that Deal, that merchant non-fulfillment may be treated as grounds for losing Deals privileges as described above. Merchant non-fulfillment does not, however, relieve a user of amounts owed to an independent Gopher for work the Gopher actually performed — the Gopher Request is a separate transaction governed by the completion, confirmation, and payment provisions elsewhere in these Terms, and payment for a Gopher's completed work is handled under those provisions regardless of a merchant's conduct.
Merchant Representations, Warranties & Indemnity
Each merchant that submits or maintains a Deal represents and warrants that its Deal, product descriptions, pricing, inventory, imagery, and content are accurate, current, lawful, and not misleading; that it holds all licenses, permits, and rights necessary to offer and fulfill the Deal; and that its Deal and its fulfillment comply with all applicable laws. In addition to the general Indemnification section, each merchant agrees to indemnify, defend, and hold harmless the Gopher Entities from and against any claim, loss, liability, cost, or expense (including reasonable attorney's fees) arising out of or relating to its Deal, its products or services, its fulfillment or non-fulfillment, its representations, or its violation of these Terms or any law.
Merchant Brand & Content License
By submitting a Deal, a merchant grants Gopher, Inc. a worldwide, non-exclusive, royalty-free, sublicensable license to use, host, reproduce, display, and distribute the merchant's name, logo, trademarks, offer details, and related content for the purpose of listing, operating, and promoting the Deal and the Gopher platform. The merchant represents and warrants that it owns or has all rights necessary to grant this license and that this content does not infringe or violate the rights of any third party. Gopher may remove or decline to display any merchant content at its discretion.
Deal Payment Disputes & Chargebacks
Because no payment for a Deal passes through Gopher, all billing questions, refunds, cancellations, and payment disputes for a Deal purchase must be pursued directly with the merchant or, where applicable, with your card issuer or payment provider. Gopher, Inc. is not a party to the payment, is not a payment processor for Deal purchases, cannot issue refunds or reverse charges for them, and is not responsible for any chargeback, dispute, or billing matter arising from a Deal purchase. Gopher's dispute-resolution process applies only to Gopher Requests, not to purchases made directly with a merchant.
Leaving Gopher; Merchant Data & Privacy Practices
When you follow a Deal to a merchant's site, you leave the Gopher environment and enter a site Gopher does not control. The merchant's own privacy policy and data practices govern any information you provide there, and the provisions on Links to Third-Party Sites & Services apply. Gopher, Inc. is not responsible for the content, security, data handling, or practices of any merchant site, and its inclusion as a Deal does not imply endorsement.
Deals Disclaimer & Limitation of Liability
Gopher Deals are provided on an “AS IS” and “AS AVAILABLE” basis, and Gopher, Inc. makes no representations or warranties of any kind regarding any merchant, Deal, product, service, or the fulfillment thereof. To the fullest extent permitted by law, the Gopher Entities have no liability arising out of or relating to any Deal, any merchant, or any transaction between a user and a merchant. Because Gopher receives no payment for Deals, its aggregate liability relating to Deals is subject to the limitation set out in our Assumption of Risk & Liability Disclaimer (Limitation of Liability), and any dispute with Gopher relating to Deals remains subject to the Arbitration & Class Action Waiver.
9Age of Usage & Age-Restricted Deliveries
You must be at least 16 years old to use Gopher in any capacity. Gopher, Inc. does not knowingly collect personal information from, or permit platform access to, any person under the age of 16. If you are between 16 and 18, you may use Gopher only with the permission and supervision of a parent or legal guardian, who accepts these Terms on your behalf and remains responsible for your activity on the platform. If you are a worker on the Gopher Go app and are under the age of 18 (a minor), our payment merchant, Stripe, will require a parent or guardian to cosign the payout account.
Age-Restricted Deliveries
Requests involving age-restricted products are prohibited to all users under the age of 21. For users 21 or older, it may be possible to request the delivery of age-restricted products in some locations. You agree to follow all applicable local, state, and federal laws. If you request any age-restricted product, you agree that you are of legal age (21+) and will provide a physical, valid government-issued ID to your Gopher upon delivery (a picture of the ID is not allowed). Your Gopher will take a photo of the physical ID before items are exchanged.
Contactless delivery is NEVER available for age-restricted requests, even with Gopher TrustShield. Attempting to use your account to circumvent age restrictions will result in a permanent ban from all Gopher, Inc. platforms.
If a Requestor cannot provide a valid ID at delivery, the Gopher will log the transaction as "Completed; ID Not Provided" and will not hand over the items. The Requestor will be charged for the entire non-refundable transaction.
10Gopher Request Fees
When submitting a Gopher Request, you agree to a pre-authorization charge for the full amount plus 20% once your request is accepted. This ensures the entire amount is available, plus a cushion for any agreed-upon cost adjustment. The pre-authorization is not an actual charge and is released if your request is cancelled. Once completed, if no cost adjustment is made, a charge is made for the original amount.
Depending on the category, the "Gopher Fee" ranges from $0.99 to $4.99, plus an 8% Instant Transfer Fee for the total transaction. All fees are non-refundable once a request is completed, and you can review an itemized breakdown before every order.
Fee Structure
- Gopher Fee — used to help Gopher grow and continuously improve the marketplace.
- Instant Transfer Fee — an 8% fee that offsets the cost of our payment merchant, Stripe, and pays your Gopher instantly.
- Age-Restricted Fee — offsets the costs of compliance with age-restricted safeguarding protocols.
- Gopher Offering — the net amount your Gopher will earn for the task. This is not a "tip"; it is exactly what they will earn.
- Cost of Items — reimbursement for an out-of-pocket purchase made on your behalf. Please enter an amount as close as possible to the actual cost.
Gopher, Inc. reserves the right to change any of the above fees at any time. We will continue to share our fee structure before a request is submitted.
11Gopher Request "Gopher Offering" Policy
When submitting a Gopher Request, there are two options: (1) Set your own price, which lets you enter the cost of items and the amount you'd like to hire a Gopher for; or (2) Allow Gophers to bid, which broadcasts the request so available Gophers can submit a bid that you approve or decline.
In either case, stating that additional funds will be earned outside of the app is a violation of these Terms. Gopher, Inc. can only fulfill a transaction if the amount is entered in the "Payment Information" section. This protects both the Requestor and Gopher from disagreements about actual money received.
If both parties agree on a different price after acceptance, this can be done in-app via the Cost Adjustment feature, initiated by the Gopher and approved by the Requestor — but only before the request is confirmed as completed. Once completed and confirmed, the transaction is finalized and cannot be refunded. Recruiting for a job may be offered, but terms and pay must be upfront and transparent; using "allow Gophers to bid" to disguise a fixed wage is strictly prohibited and grounds for an immediate ban.
12Gopher Go Payout Account
To receive payout opportunities, you must have an authorized Gopher Profile (legal name, actual date of birth, permanent address, and a recent picture). When adding your debit card (we cannot add money to credit cards), the information must match your Gopher Profile exactly. When setting up your payout account, you create a Stripe account through their secure portal. Gopher, Inc. does not own or store the information entered during setup (debit card number, SSN, and valid ID). Stripe requires this to comply with U.S. banking laws.
Payout Sequence
- Review the request and determine whether you can fully perform it.
- Agree to the "Gopher Go Cancellation Policy" and accept the request.
- Once connected to the Requestor, message them with your ETA and confirm details.
- Update the request progress (In-Progress → Items Pick-Up, if applicable).
- Update the request to "Completed" once finished.
When "Confirmed," the payout for a new Gopher is "Standard Payout" speed (up to 24–48 hours) for the first 10 completed requests. After 10 completed requests, the Gopher upgrades to "Instant Payout" with deposits arriving within 1–2 minutes. If "Dispute" is selected, a dispute alert is sent with instructions to attempt resolution. Keep your debit card up to date; an expired or invalid card will delay your payout.
13Gopher Go Payout Fraud
If we determine a Gopher Go worker has maliciously logged "Completed" with the intent to defraud, Gopher will file criminal charges without hesitation, including all related transaction information. When a request has been accepted, asking the Requestor for additional funds — other than a legitimate cost adjustment — is a violation and grounds for immediate account deactivation. Asking a Requestor to complete a request early (before it is actually completed), for any reason, is cause for immediate removal from the platform.
14Purchase Needed Requests
When a request uses the Purchase Needed icon, the Gopher makes the purchase with their own money initially, at retail cost. You will see a "Total" (the deposit you receive on completion), an "Earn" amount (your profit), and a "Spend" amount (your short-term out-of-pocket expense). If you do not have funds to cover the "Spend" amount, do not accept the request.
For "Purchase Needed – Age-Restricted" requests, the Requestor MUST be present at the delivery address. If the Gopher arrives and the Requestor is not present, they may start a 10-minute timer. If the Requestor does not appear with a valid ID within 10 minutes, the request is completed and paid out to the Gopher in full. This is not a refundable transaction.
15Counter-Offers & Cost Adjustments
Counter-Offers
On the Gopher Go App, some requests allow counter-offers, capped at 150% of the original offer (with a minimum of $20). The feature is meant to turn an unrealistic offer into a fair one. Abusing it may lead to deactivation. If your counter-offer is not accepted, do not accept the request and then use Cost Adjustment to ask for more — this is a violation.
Standard Gophers are allowed 5 counter-offers per month. Elite, Elite+, and Pro Gophers receive unlimited counter-offers as a Pro perk of their verification tier. The 150% cap described above does not apply to Elite, Elite+, or Pro Gophers, whose counter-offers are not capped.
The counter-offer feature is not to be taken lightly or misused. Submitting a counter-offer is a binding offer to the Requestor. If the Requestor accepts it, their payment method is authorized for the countered amount and a binding agreement is formed between you and the Requestor on those terms. You are then expected to complete the request according to its description, and you will be paid the countered amount upon completion. Submitting counter-offers you do not intend to honor, or failing to perform after a counter-offer is accepted, is a misuse of the feature and may result in cancellation, withheld payment, and deactivation.
Cost Adjustments
If the listed cost of items is not enough to cover the actual cost, the Gopher can make a cost adjustment, which requires Requestor approval. The cost-of-items section is always meant to be a wash — neither to make nor lose money. Your earnings are the "Gopher Offering." Gophers should not purchase items significantly above the entered amount before submitting a cost adjustment, as the adjustment may fail. Gopher, Inc. is not responsible for recovering costs above the authorized amount.
16Completing / Confirming a Request
When a worker updates a request to "Completed," the Requestor receives a notification via App and SMS and is given two options:
- Confirm Completion — finalizes the order; a receipt is emailed immediately, payment is transferred to the worker, and it cannot be cancelled or refunded. Tapping this serves as your electronic signature.
- Dispute — you and your Gopher can work together to resolve any issues, with all app features available during the dispute.
The Gopher's progress is GPS-stamped at each update (Start, In-Progress, Items Picked-Up/Purchased, Completed). The Requestor has a 48-hour Grace Period to confirm or dispute. If no action is taken within the Grace Period, the request is considered completed and payment is made automatically — there are no refunds from automatic payouts.
17Cancellation & Refund Policy
Once a Gopher has accepted your request, you can still cancel it — or instantly repost it to other Gophers — at no charge, as long as your Gopher has not started and has not purchased any items. Once your Gopher has started the job and/or purchased items on your behalf, the request may no longer be cancelled for free. If a request has been updated to "Items Purchased," it cannot be cancelled, as the Gopher has already incurred an out-of-pocket expense.
Cancellation Fees
If your Gopher has started the request ("in-progress") and/or purchased items on your behalf, cancelling is subject to a flat $5 cancellation fee, and if items were already purchased you are also responsible for the cost of those items. On the worker side, Gophers are expected to complete the jobs they accept. If a Gopher cancels after accepting and the cancellation is not excused, it is reviewed; a confirmed unapproved cancellation may carry a flat $5 fee, deducted from the Gopher’s next payout, but only after repeated unexcused cancellations — never on a first occurrence. Cancellations outside the Gopher’s control are excused with no fee. Repeated unexcused cancellations can lead to account deactivation, and consistent five-star work restores a Gopher’s standing.
This section governs individual Gopher Requests. Gopher Connect subscription charges (the Connect Business plan) are non-refundable and are governed by the Gopher Connect section (Connect Business Subscription — Billing, Cancellation & Refunds).
18Dispute Protocol & Resolution
If a dispute is entered, an alert is sent to the Gopher with resolution instructions. If a customer asked for "X" and received "Y" (the wrong item), this is not an issue Gopher, Inc. is responsible for — the Gopher would need to correct the issue and return with the correct item, after which the dispute is reversed and confirmed. Alternatively, both parties may agree on a Cost Adjustment.
Requestors should not use the dispute option for a delay or timing issue — that is what ratings are for. If parties cannot resolve a dispute, either may submit a resolution request to Gopher, Inc., which may review transaction logs, documentation, and user history. Any dispute resolution determinations made by Gopher, Inc. are final.
19Fraudulent Chargebacks & Restitution
Any fraud attempted on the platform will be turned over to the authorities without hesitation, including all related transaction information (GPS time stamps, identification, receipts, etc.). Chargeback fraud is considered a form of theft and is a criminal act. When customers dispute a legitimate charge, they are essentially stealing from the worker and the platform.
If a fraudulent chargeback is made, you can assume the financial consequences will be more than double the amount charged back. We provide multiple ways to resolve a dispute immediately, so circumventing the process with a chargeback is a violation of these Terms and we will seek damages.
20In-App Communication & Accessibility
Gopher's in-app messaging exists for one purpose: legitimate, request-related communication. Before a request is accepted, an available Gopher may message the Requestor to ask a clarifying question when more information is needed; while a request is live, both parties may coordinate to complete it. Messaging a Requestor does not "connect" you to a request — even if the Requestor verbally commits, the request must be accepted in the app to earn the work.
Keeping transactions on the platform is mandatory. Neither a Requestor nor a Gopher may use messaging — or any other means — to solicit, encourage, arrange, or complete a transaction outside the app, or to circumvent Gopher's fees. This prohibition applies to both parties and includes sharing or requesting phone numbers, email addresses, social-media handles, off-app payment or payment-app details (for example Venmo, Cash App, Zelle, or PayPal), or an address beyond what a job legitimately requires, as well as offering or accepting payment outside the app. A Gopher can only fulfill a transaction through the platform; if either party proposes paying or being paid outside the app, that is a violation of these Terms — decline it and contact support@gophergo.io immediately.
Messages are moderated. To protect users, in-app messages are automatically screened for content that signals an attempt to take a transaction off-platform or to exchange contact or payment details — including phone numbers, email addresses, physical addresses, dollar amounts, and payment-app references. When such content is detected, the sender is warned and given the opportunity to correct the message before it is sent; if the sender proceeds anyway, the offending content is masked before it reaches the recipient and the message is flagged for review. Attempting to disguise, misspell, or spell out this information to defeat screening is itself a violation.
Consequences. Flagged messages and off-platform solicitation are reviewed and enforced on an escalating basis — up to and including a warning, masking of the message, restriction or loss of messaging, flagging of the account, suspension, and, for serious or repeat violations, permanent removal from the platform. Circumventing the platform to avoid fees is a material breach of these Terms, and a Gopher who solicits or accepts payment outside the app may also forfeit pending payouts. Any arrangement made or completed off-platform is entirely at the parties' own risk: it is not covered by Gopher's payment escrow or completion guarantee, dispute resolution, TrustShield, background-check or credential programs, or any other platform protection, and Gopher, Inc. bears no responsibility or liability for it.
While engaging in a live request, both Requestor and Gopher must have acceptable means to communicate and be responsive within a reasonable time frame. Gopher, Inc. reserves the right to cancel any request where one party is unresponsive for a prolonged period (greater than one hour for a delivery is on the fringe of reasonable).
21Gopher Features
I'll Select My Worker
When a Requestor chooses "I'll select my worker," the request is broadcast as usual. When a Gopher accepts, the Requestor can view their prior performance, ratings, and reviews before selecting them. Accepting an "I'll select my worker" request does not mean you are connected to the job — you will be notified if selected.
MY Gopher (formerly "Favorite Gopher")
When a Requestor chooses "Prioritize MY Gophers," the request is first broadcast to their "MY Gophers" list for one minute (the "Exclusive Period") before opening to all other Gophers. This feature was inspired by the greatest Gopher we have ever known, the late Michael Yorrie (3,677 completed requests, all 5 stars). After his passing, we renamed this feature from Favorite Gopher to MY Gopher, permanently etching his place in our story.
22Trust & Safety Initiatives
Gopher, Inc. is committed to providing a platform users feel confident in. Building trust between neighbors who may be meeting for the first time is central to how Gopher works, so we've implemented a layered set of verification and screening tools: Gopher Elite+, Gopher Elite, and Gopher Pro designations, along with Gopher TrustShield ID Verification. Together, these initiatives help Requestors and Gophers transact with greater peace of mind. Participation is optional, but the resulting profile badges help build credibility within the community and may make a Gopher more likely to have their offers accepted.
Gopher Elite+ & Gopher Elite (Background Screening with Yardstik)
Gopher has teamed up with Yardstik for a one-time, fee-based background check. Once cleared, Gophers receive a profile badge showcasing they have cleared a National Criminal search, National Sex Offender search, OFAC and Most Wanted List search, and Address/SSN trace — this is the Gopher Elite designation. Gopher Elite+ includes everything in Gopher Elite plus an additional Motor Vehicle (DMV) Search, which is especially relevant for Gophers offering driving, delivery, or transport-related help. Both Gopher Elite and Gopher Elite+ are one-time fees and are not recurring or subscription-based, and the fee is non-refundable. You must be at least 16 years old to apply. A badge reflects status as of the date the check was completed and does not guarantee any future conduct; Gopher, Inc. does not perform continuous monitoring and makes no representation or warranty regarding any user beyond the limited scope of the searches performed by Yardstik.
Background-check payments and screening disputes are handled directly by Yardstik. Gophers pay Yardstik directly for the check, and Yardstik provides results, support, and dispute resolution for the screening itself; support information is provided by Yardstik at the time of submission. Gopher, Inc. does not collect, process, or refund background-check payments and is not responsible for resolving concerns related to a failed, delayed, or disputed screening inquiry — those must be pursued through Yardstik. Gopher Pro (Licensed, Bonded & Insured)
A Gopher Pro designation indicates that a Gopher offers work that may require professional credentials — for example a skilled tradesperson, contractor, or other professional — and has submitted those credentials to Gopher. There is no fee for the Gopher Pro designation. Unlike a self-reported badge, Gopher, Inc. formally verifies the submitted credentials and their expiration dates before granting Pro status.
Maintaining Pro status requires annual re-verification. Each year, a Gopher Pro must provide current proof that their credentials remain valid; if valid proof is not provided, the designation will lapse. Verification confirms the documentation provided and its stated validity and expiration dates as of the date of review — it is not a guarantee of work quality, ongoing validity, or sufficiency for any particular job, and Requestors remain responsible for confirming that a Gopher's credentials are appropriate for their specific needs. If Gopher later becomes aware of a violation or circumstance that would constitute grounds for a failed credential or background review, the Gopher will, at a minimum, lose the Gopher Pro badge and may be removed or expelled from the platform.
Gopher TrustShield (ID Verification with iDenfy)
Gopher has teamed up with iDenfy to offer ID verification for Gopher Request users at no cost. Once verified, users earn a TrustShield badge. Users under 30 looking to have age-restricted items delivered are required to verify through TrustShield. Note: for age-restricted deliveries, Requestors with TrustShield will still show their valid ID during the items exchange. TrustShield verification confirms identity at the time of the check and is intended to reduce fraud and support responsible age-restricted commerce; it does not replace the in-person ID check required for age-restricted items, and it is not a substitute for your own judgment when arranging a Gopher.
Badges & Screening Are Informational Only
All Gopher badges and designations — including Gopher Elite, Gopher Elite+, Gopher Pro, and Gopher TrustShield — are provided for informational purposes only. They are not endorsements, guarantees, recommendations, warranties, or assurances of any user's safety, trustworthiness, character, qualifications, work quality, or future conduct. A background check or verification reflects only the limited information available as of the date it was performed and is not a guarantee of safety, trustworthiness, future conduct, or suitability for any particular request. Gopher, Inc. does not endorse, recommend, or vouch for any Requestor or Gopher, and each user remains responsible for exercising their own judgment when deciding whether to transact with another user.
23Ratings & Removal from Platform
After a request is completed, both Requestor and Gopher can rate the transaction and add comments. Ratings impact the order in which Gophers see requests, so please be mindful and fair. If a request was completed to expectation, please rate your Gopher a 5. Gopher, Inc. reserves the right to remove any user with excessive poor ratings when deemed in the best interest of all users. Additionally, taking more than one "Need ASAP" request at a time is not advised; the completion-time expectation for all "Need ASAP" requests is 40–60 minutes max.
24Deactivated & Suspended Accounts
If Gopher, Inc. disables your account for a policy violation, an email will be sent with an explanation. You may request reinstatement by emailing support@gophergo.io. If a new account is created by a deactivated user, it will be immediately deleted. If sign-in access is suspended due to suspicious activity, an email will be sent. If the OTP is entered incorrectly more than twice, your account will be flagged and temporarily suspended — contact support for immediate assistance. You can also try texting START to 919-887-7143 (our automated one-time-passcode and messaging line) if your account was inadvertently blocked from receiving messages.
25Licensed / Bonded / Insured Credentials
Many Gophers offer general help that does not require a license. When requesting help from a worker whose service does require unique credentials, customers should confirm those credentials before work starts. Gopher, Inc. allows workers to upload credentials to their profile; for non-Pro workers these uploads are self-reported, and verification remains the hiring customer's responsibility.
For workers who hold the Gopher Pro designation, Gopher, Inc. formally verifies the submitted credentials and expiration dates as described in our Trust & Safety Initiatives section, and requires annual re-verification to keep the badge active. This verification confirms the documentation and validity dates provided as of the date of review; it does not guarantee the scope, sufficiency, or continued validity of any license, bond, or insurance policy for a particular job, and Requestors are still encouraged to confirm that a Gopher's credentials fit their specific needs. All labor requests require agreement to Gopher, Inc.'s Release of Liability and Assumption of Risk policy.
26Links to Third-Party Sites & Services
Gopher, Inc. may contain links to other websites ("Linked Sites") that are not under Gopher's control. Gopher is not responsible for the contents of any Linked Site and provides these links only as a convenience; inclusion does not imply endorsement. Certain services are delivered by third-party sites; by using any functionality originating from the Gopher domain, you consent that Gopher may share information with third parties with whom it has a contractual relationship to provide the requested service.
27No Unlawful or Prohibited Use / Intellectual Property
You are granted a non-exclusive, non-transferable, revocable license to access and use Gopher, Inc. strictly in accordance with these Terms. You warrant that you will not use the Site for any unlawful or prohibited purpose, or in any manner that could damage, disable, overburden, or impair the Site.
All content included as part of the Service — text, graphics, logos, images, and the compilation thereof — is the property of Gopher or its suppliers and protected by intellectual property laws. You will not modify, publish, transmit, reverse-engineer, sell, or create derivative works from any content. Your use of the Site does not grant you any ownership rights in any protected content.
License to Content You Submit
You retain ownership of the content you submit to the platform — including reviews, ratings, comments, photos, images, testimonials, profile pictures, logos, and business content ("User Content"). By submitting, posting, or uploading User Content, you grant Gopher, Inc. a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, use, reproduce, modify, adapt, publish, translate, publicly display, and distribute that User Content in connection with operating, providing, promoting, marketing, advertising, and improving the platform and Gopher's services. This license continues for as long as the User Content remains on the platform and for a commercially reasonable period thereafter for backup and record-keeping purposes. You represent and warrant that you own or otherwise have all rights necessary to grant this license and that your User Content does not infringe or violate the rights of any third party.
28Copyright, Trademark & Content Takedown
Gopher, Inc. respects the intellectual property rights of others and expects users to do the same. Because users may upload content such as profile photos, reviews, images, logos, and business content, Gopher maintains a notice-and-takedown process for claims of infringement and will, in appropriate circumstances, remove infringing content and terminate the accounts of repeat infringers.
Reporting Copyright Infringement (DMCA Notice)
If you believe content on the platform infringes your copyright, please send a written notice to Gopher's designated agent at legal@gophergo.io that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material claimed to be infringing and information reasonably sufficient to locate it; (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Counter-Notification
If your content was removed and you believe the removal was a mistake, you may submit a counter-notification to legal@gophergo.io containing your signature, identification of the removed material and the location where it previously appeared, a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification, your contact information, and your consent to jurisdiction as required by applicable law.
Trademark & Other Complaints
Trademark complaints and other content-removal requests may also be sent to legal@gophergo.io. Gopher may remove or disable access to any content at its discretion and will respond to valid requests as required by law.
29Indemnification
You agree to indemnify, defend, and hold harmless Gopher, its officers, directors, employees, agents, and third parties for any losses, costs, liabilities, and expenses (including reasonable attorney's fees) relating to or arising out of your use of (or inability to use) the Site or services, any user postings made by you, your violation of these Terms, your violation of any rights of a third party, or your violation of any applicable laws.
30Arbitration & Class Action Waiver
In the event the parties cannot resolve any dispute arising out of these Terms, such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator administered by the American Arbitration Association, in a North Carolina location mutually agreed upon by the parties. The prevailing party is entitled to recover its costs and reasonable attorney's fees. This arbitration provision survives termination of these Terms.
Class Action Waiver. Any arbitration will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. The parties agree that a party may bring claims against the other only in each's individual capacity, and not as a plaintiff or class member in any putative class, collective, or representative proceeding.
31Assumption of Risk & Liability Disclaimer
To the full extent permitted by law, Gopher, Inc. and its officers, directors, employees, agents, licensors, affiliates, and successors ("Gopher Entities") make no promises, warranties, or representations as to Gopher, Inc., including its completeness, accuracy, availability, timeliness, security, or reliability; provide Gopher, Inc. on an "AS IS" and "AS AVAILABLE" basis with any risk assumed by you; and disclaim all warranties, express or implied. Gopher, Inc. is not liable for any direct, indirect, consequential, incidental, special, or punitive losses.
Gopher (Worker) Assumption of Risk & Release
By accepting or performing any service through Gopher, each Gopher acknowledges that they are voluntarily engaging in independent work activities and assume all risks associated with those activities, including but not limited to bodily injury, illness, death, vehicle and transportation accidents, lifting and repetitive-motion injuries, slips, trips, and falls, property damage, interactions with Requestors, animals, and third parties (including assault or other misconduct by another person), exposure to weather conditions, and the use of tools, equipment, vehicles, and hazardous environments.
Each Gopher understands and agrees that Gopher, Inc. is not an employer, joint employer, staffing agency, contractor, subcontractor, or supervisor of any work performed through the platform. Gopher, Inc. does not provide workers' compensation insurance, occupational accident insurance, disability insurance, unemployment insurance, health insurance, or general liability insurance for Gophers unless expressly stated in writing. Each Gopher is solely responsible for reporting and paying all applicable federal, state, and local taxes on amounts earned through the platform, and for obtaining any insurance, workers' compensation coverage, or benefits they desire or are required by law to maintain.
To the fullest extent permitted by law, each Gopher releases, waives, and agrees not to assert any claim against the Gopher Entities arising from any injury, illness, death, loss, or damage sustained while preparing for, traveling to or from, or performing any service obtained through the platform — whether caused by a Requestor, a third party, an animal, equipment, the condition of any premises, or otherwise.
Requestor Assumption of Risk & Release
Because Gopher, Inc. acts only as a connector and does not perform, supervise, or vet the services arranged through the platform, each Requestor likewise assumes all risks arising from a Gopher's performance of a service, including but not limited to property damage, theft, personal injury, the quality or completeness of work, and the conduct of any Gopher or third party. It remains the Requestor's responsibility to verify a Gopher's identity, credentials, licensing, bonding, and insurance before work begins, as described elsewhere in these Terms.
To the fullest extent permitted by law, each Requestor releases, waives, and agrees not to assert any claim against the Gopher Entities arising from any act, omission, injury, loss, or damage caused by or related to a Gopher or any service arranged through the platform.
Third-Party Merchant Product Liability
Gopher, Inc. does not sell, manufacture, distribute, inspect, store, package, or warrant any goods purchased from third-party merchants. Once factory-sealed products are delivered in unopened condition, all risk of loss, defect, contamination, expiration, missing components, allergic reactions, injury, recall issues, or product failure transfers exclusively to the Requestor and the merchant. All returns, refunds, replacements, recalls, and warranty claims must be pursued directly with the applicable merchant or manufacturer.
Property Access & Securing Valuables
Many services involve a Gopher entering a Requestor's home, vehicle, or property, or handling a Requestor's belongings. Requestors are solely responsible for securing cash, jewelry, valuables, important documents, pets, firearms, medications, hazardous materials, and any other sensitive or dangerous property before services begin. Gopher, Inc. is not responsible for safeguarding such property and is not liable for any loss, theft, damage, or injury arising from a Requestor's failure to secure it.
Limitation of Liability
To the maximum extent permitted by applicable law, the total aggregate liability of the Gopher Entities for any and all claims arising out of or relating to these Terms, the platform, or your use of (or inability to use) the platform or services shall not exceed the greater of (a) $100 (USD) or (b) the total fees paid by you to Gopher, Inc. during the twelve (12) months immediately preceding the event giving rise to the claim. This limitation applies regardless of the legal theory on which a claim is based and even if a stated remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations of liability, so portions of this limitation may not apply to you.
32Vehicles, Tools & Equipment
Some services arranged through the platform involve driving, delivery, rides, hauling, or transport. Gopher, Inc. does not own, maintain, inspect, certify, register, or insure any vehicle used by a Gopher, and does not confirm a Gopher's driver's license, registration, or insurance status. Each Gopher is solely responsible for operating any vehicle lawfully and safely and for maintaining all legally required licensing and insurance.
Gophers are solely responsible for the condition, legality, maintenance, suitability, and safe operation of any tools, vehicles, ladders, trailers, equipment, supplies, or materials they use in performing a service. Gopher, Inc. does not provide, inspect, or warrant any such items and assumes no liability for any injury, death, property damage, or other loss arising from their use, whether to the Gopher, a Requestor, or any third party.
33Termination, Access Restriction & Governing Law
Gopher reserves the right, in its sole discretion, to terminate your access to the Site, Apps, and related services at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of North Carolina, and you consent to the exclusive jurisdiction and venue of courts in North Carolina in all disputes arising out of or relating to the use of the Site.
No joint venture, partnership, employment, or agency relationship exists between you and Gopher as a result of this agreement. If any part of this agreement is found invalid or unenforceable, that provision will be superseded by a valid, enforceable provision that most closely matches the original intent, and the remainder shall continue in effect. Unless otherwise specified, this agreement constitutes the entire agreement between you and Gopher with respect to the Site. It is the express wish of the parties that this agreement be written in English.
34Force Majeure
Gopher, Inc. shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, fire, flood, severe weather, epidemic or pandemic, war, terrorism, civil unrest, labor disputes, governmental action, power or telecommunications failures, internet or hosting outages, or the acts or omissions of third-party service providers. Performance obligations affected by such an event are suspended for the duration of the event.
35Taxes
Each user is responsible for determining and meeting their own tax obligations arising from use of the platform. Gophers are independent contractors and are solely responsible for reporting and paying all applicable federal, state, and local income and self-employment taxes on amounts they earn, along with any related filings. Gophers must report all earnings regardless of the amount and regardless of whether they receive any tax form. Merchants participating in Gopher Deals or otherwise selling through or in connection with the platform are solely responsible for determining, collecting, and remitting any applicable sales, use, or other transaction taxes on their sales. Requestors and other users are responsible for any applicable local taxes or fees associated with the goods or services they obtain.
Where Gopher, Inc. is required by law to collect and remit taxes as a marketplace facilitator, it will do so, and any such amounts may be calculated and displayed at checkout. Except as expressly required by law, Gopher does not determine, collect, remit, or advise on any user's tax obligations, and nothing in these Terms constitutes tax advice.
Gopher may provide payment summaries, reports, reminders, or similar tools (for example, consolidated worker-payment histories within Gopher Connect) as a convenience. These tools are informational only, do not constitute tax advice, and do not determine any user's tax or reporting obligations. Gopher, Inc. is not the payer of record, does not issue Form 1099 or any other tax form on a user's behalf, and does not file or remit taxes for any user unless expressly required by law. Businesses and other payers are solely responsible for determining and meeting their own information-reporting obligations and for applying the reporting thresholds then in effect, which change over time. Any totals, thresholds, or reminders shown within the platform are provided for general convenience, may not reflect current law, and should not be relied upon; users should consult their own tax professional.
36Records Retention & Evidence Preservation
To support fraud prevention, safety, dispute resolution, and legal compliance, Gopher, Inc. may collect, retain, and preserve records relating to platform activity, including transaction and payment records, in-app chat and communication history, GPS and location logs, photos and documentation submitted with a request, ratings and reviews, device and log data, and identity-verification records. Gopher may retain such records for as long as reasonably necessary for these purposes or as required by law, including after an account is closed.
Gopher may access, preserve, and disclose these records where it believes in good faith that doing so is reasonably necessary to investigate suspected fraud or misconduct, resolve a dispute, enforce these Terms, protect the rights, property, or safety of users or the public, or comply with a law, regulation, legal process, or governmental request. This Section operates together with our Privacy practices.
37Survival
Any provision of these Terms that by its nature should survive termination will survive, including without limitation the Arbitration & Class Action Waiver, Indemnification, the Assumption of Risk & Liability Disclaimer (including the Limitation of Liability), any accrued payment obligations, and the intellectual-property and content-license provisions. Termination of these Terms or of your account does not relieve you of obligations that accrued before termination.
38Assignment
You may not assign or transfer these Terms, or any of your rights or obligations under them, without Gopher's prior written consent. Gopher, Inc. may assign or transfer these Terms, in whole or in part, without notice or consent, including in connection with a merger, acquisition, reorganization, financing, or sale of all or substantially all of its assets. These Terms bind and benefit the parties and their permitted successors and assigns.
39Export & Sanctions Compliance
You represent that you are not located in, organized under the laws of, or ordinarily resident in any country or region subject to comprehensive U.S. sanctions, and that you are not identified on any U.S. government list of prohibited or restricted parties. You agree to comply with all applicable export-control and economic-sanctions laws and not to use the platform in violation of them.
40Changes to Terms
Gopher reserves the right, in its sole discretion, to change the Terms under which Gopher, Inc. is offered. The most current version of the Terms will supersede all previous versions. We encourage you to periodically review the Terms to stay informed of our updates.
